1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of the MBharat website, mobile applications and related services (together, the "Platform"). The Platform is owned and operated by MBharat Company Pvt Ltd ("MBharat", "we", "us" or "our"), a company incorporated in India.

By creating an account, accessing or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Platform.

2. Definitions

• "Entrepreneur" or "Seller" means a user who lists products, services, workshops or exhibitions on the Platform.
• "Customer" or "Buyer" means a user who browses, enquires about or purchases listings.
• "Content" means any text, images, listings, reviews, ratings or other material uploaded to the Platform.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law. By using the Platform you represent that all registration information you provide is accurate and kept up to date. Businesses and self-help groups may register through an authorised representative.

4. Account Registration & Security

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Notify us immediately at info@mbharat.com of any unauthorised use of your account.
• We may suspend or terminate accounts that provide false information, violate these Terms or are used for fraudulent activity.

5. Role of MBharat

MBharat is an intermediary that provides a technology platform connecting Entrepreneurs and Customers. We are not the manufacturer, seller or provider of any product or service listed on the Platform. Contracts for the sale of goods or services are formed directly between the Entrepreneur and the Customer. MBharat does not guarantee the quality, safety, legality or availability of any listing. 6. Listings & Entrepreneur Obligations

• Provide accurate descriptions, pricing (in INR), images and delivery or service timelines.
• Hold all licences, registrations and approvals required to sell your products or provide your services (including FSSAI registration for food items, where applicable).
• Honour confirmed orders, enquiries and bookings and communicate promptly with Customers.
• Comply with applicable laws, including consumer protection, tax, packaging and labelling requirements.

7. Customer Obligations

• Provide correct contact, delivery and payment information.
• Use the Platform only for lawful, personal or legitimate business purposes.
• Raise concerns about an order directly with the Entrepreneur first, and with MBharat support if unresolved.

8. Payments

Payments made through the Platform are processed by third-party payment gateways in Indian Rupees. MBharat may charge platform fees, subscription charges or commission, which will be disclosed to you before they apply. You are responsible for any applicable taxes on your transactions.

9. Cancellations, Returns & Refunds

Cancellations, returns and refunds are governed by our Refund Policy and, where relevant, the individual Entrepreneur's stated policy. Please review both before making a purchase.

10. Prohibited Conduct

You agree not to:

• Post content that is unlawful, misleading, obscene, defamatory, infringing or hateful.
• List prohibited or restricted items (weapons, drugs, counterfeit goods, hazardous materials, or anything banned under Indian law).
• Attempt to bypass fees, manipulate ratings, scrape data, or introduce malware or automated bots.
• Impersonate any person or misrepresent your affiliation with any entity.

11. Intellectual Property

The Platform, including its logo, design, text, graphics and software, is owned by MBharat Company Pvt Ltd or its licensors and is protected by applicable intellectual property laws. You may not copy, modify or distribute any part of the Platform without our prior written consent. By posting Content, you grant MBharat a non-exclusive, royalty-free licence to host, display and promote that Content in connection with operating the Platform.

12. Reviews & Ratings

Reviews must reflect genuine experiences. We may remove reviews that are fake, incentivised, abusive or that violate these Terms.

13. Suspension & Termination

We may suspend, restrict or terminate your access to the Platform, with or without notice, if you breach these Terms, create risk or legal exposure for us, or engage in fraudulent or harmful behaviour. You may close your account at any time by contacting support.

14. Limitation of Liability

To the maximum extent permitted by law, MBharat and its directors, employees and partners shall not be liable for any indirect, incidental or consequential loss, or for disputes, defects, delays or damages arising from transactions between users. Our total liability for any claim shall not exceed the platform fees paid by you to MBharat in the three months preceding the claim.

15. Indemnity

You agree to indemnify and hold harmless MBharat Company Pvt Ltd against any claims, losses, liabilities and expenses arising from your use of the Platform, your listings or transactions, or your breach of these Terms or any law.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to any applicable arbitration or consumer forum rights, the courts at Nashik, Maharashtra shall have exclusive jurisdiction over any dispute.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Platform or by email. Continued use after changes take effect constitutes acceptance.
